Membership Agreement
Welcome to PubEasy. By accessing any areas of PubEasy, users
("Users") agree to be
bound by the terms set forth below.
- PUBEASY’S ROLE:
PUBEASY'S responsibility and role is
to provide links to
formatted, secure web sites of its participating
publishers, distributors, wholesalers
and other third parties (who
are referred to in this agreement as "Affiliates") PUBEASY
has developed and provides a standard user interface which is shared
by all
participating Affiliates and which allows Users to access
Affiliate sites.
- LIMITATION OF PUBEASY’S RESPONSIBILITY:
PUBEASY is not
responsible for
the content or functionality of Affiliate sites and
therefore, USER ACKNOWLEDGES
AND AGREES THAT PUBEASY DOES NOT
WARRANT THE FOLLOWING :
- the accuracy of data provided at any site or the shipment of
orders placed
at any site;
- the business procedures of Affiliates with respect to
Affiliate sites;
- that its use will be uninterrupted or free of errors,
omissions, interruptions,
deletion of files or email, viruses or
delays in operation or transmission;
and as a result USER HOLDS HARMLESS AND INDEMNIFIES PUBEASY from
any claim by User or any Affiliate for damages of any sort resulting
form transactions conducted by User on any Affiliate site or
elsewhere in PubEasy. PubEasy is
provided on an "as is,"
"as available" basis without warranties of any kind,
either
expressed or implied, including but not limited to warranties
of title or implied
warranties of merchantability or fitness for a
particular purpose. User expressly
agrees that use of PUBEASY is at
User's sole risk.
- USE OF INFORMATION
: PubEasy collects statistical
information regarding activity,
preferences, etc. of Users and
PUBEASY may choose to use such information
together with authorized
third parties in conjunction with online and or offline offerings
or
by email. USER AUTHORIZES PUBEASY to use their email in connection
with
PubEasy related updates, news alerts and new product offerings.
OWNERSHIP OF CONTENT: All content on the PUBEASY site is
owned by PUBEASY
unless specifically protected by a third party’s
trademark or copyright.
ONLINE CONDUCT:
Any conduct by a User that in
PubEasy’s sole discretion restricts
or inhibits any other User
from using or enjoying PubEasy will not be permitted. User
agrees to
use PubEasy only for lawful purposes. User is prohibited from
posting on or
transmitting through PubEasy any unlawful, harmful,
threatening, abusive, harassing,
defamatory, vulgar, obscene,
sexually explicit, profane, hateful, racially, ethnically, or
otherwise objectionable material of any kind, including but not
limited to any material
that encourages conduct that would
constitute a criminal offense, give rise to civil liability,
or
otherwise violate any applicable local, state, national, or
international law.
TERMINATION OF USAGE: PubEasy may terminate User
access, or suspend any
User's access to all or part of PubEasy,
without notice, for any conduct that PubEasy,
in its sole
discretion, believes is in violation of any applicable law or is
harmful to the
interests of another User, an Affiliate, PubEasy or
any other third-party.
ACKNOWLEDGMENT
This Agreement represents the entire understanding between you and
PubEasy regarding your
relationship with PubEasy and supersedes any
prior statements or representations.
YOU AGREE TO BE BOUND BY THE MEMBERSHIP AGREEMENT/TERMS OF USE by
using any PubEasy web site.
The aforementioned Membership Agreement/Terms of Use are subject to
change.
